1. Seller and scope

These Terms & Conditions apply to all orders placed by consumers and business customers through the PLASH Mocktails Shopify shop. Any differing terms of a customer apply only if expressly accepted by us in writing.

2. Products and product information

We sell alcohol-free mocktails with electrolytes and related products, including gift boxes and personalised corporate-gifting products. Product images are illustrative. Minor differences in colour, packaging or presentation may occur without affecting the essential characteristics of the product.

Customers are responsible for reading the ingredient, allergen, nutrition and storage information shown on the product page and packaging before consumption. Product availability is subject to stock.

3. Prices and taxes

Prices are displayed in the currency shown in the online shop. For consumer sales in Switzerland, the price displayed at the point of purchase includes applicable Swiss VAT and mandatory charges unless expressly stated otherwise. Delivery costs and any optional charges are shown before the order is submitted.

For deliveries outside Switzerland, import VAT, customs duties, clearance fees or other local charges may be payable by the recipient unless the checkout expressly states that these charges are included. Business-customer prices may be shown excluding VAT where clearly indicated.

4. Order process and conclusion of contract

Product presentations in the online shop are an invitation to place an order and are not a binding offer. The customer submits a binding order by completing the checkout and clicking the final payment-order button.

An automatic order-confirmation email confirms receipt of the order but does not necessarily constitute acceptance. The contract is concluded when we expressly accept the order, confirm shipment or otherwise begin performance. We may reject or cancel an order in the event of non-availability, incorrect pricing, payment failure, suspected fraud or an obvious error. Any payment already received will be refunded.

Before submitting an order, customers can review and correct input errors in the checkout.

5. Payment

Available payment methods are shown at checkout and may include credit or debit card, accelerated checkout services or other payment providers. Payment is due when the order is placed unless another arrangement has been agreed in writing.

Payment processing may be carried out by third-party providers under their own terms and privacy policies. We reserve the right to suspend delivery until full payment has been received.

6. Delivery and collection

Delivery is made to the address entered by the customer. The customer must ensure that the delivery information is complete and correct. Additional costs caused by an incorrect or incomplete address may be charged to the customer.

Estimated delivery times are shown in the shop or order confirmation. They are estimates unless expressly guaranteed. Delays caused by carriers, customs, force majeure, shortages or other circumstances outside our reasonable control do not affect delivery times. not automatically entitle the customer to compensation.

Where collection is offered, the order may be collected only after the customer receives confirmation that it is ready. The stated collection location and opening arrangements apply.

7. Transfer of risk

For consumer orders, risk passes to the customer when the goods are delivered to the customer or a person designated by the customer. For business customers, risk passes when the goods are handed to the carrier or made available for collection, unless otherwise agreed.

8. Inspection, damage and incorrect deliveries

Customers should inspect the delivery promptly. Visible transport damage, missing items or incorrect products should be reported to fun@drinkplash.com as soon as possible, preferably within 48 hours, together with the order number and photographs. This notification period does not limit mandatory statutory rights.

9. Returns and withdrawal rights

Swiss law does not provide a general statutory cooling-off period for ordinary online purchases. We therefore do not accept returns merely because a customer changes their mind, unless a voluntary return right is expressly stated on the product page or agreed by us in writing.

Where mandatory consumer law in the customer’s country grants a right of withdrawal, that right applies. For EU consumers, this will generally be 14 days from receipt of the goods, subject to legal exceptions. The customer must notify us clearly by email before returning goods. Unless required otherwise by law, return shipping costs are borne by the customer.

Returned beverages must be unopened, sealed, unused, undamaged and suitable for resale. The statutory withdrawal right does not apply to goods made to the customer’s specifications or clearly personalised, and may not apply to goods that are liable to deteriorate or expire rapidly. Refunds are made to the original payment method after inspection, less any lawful deduction for diminished value.

10. Personalised and custom products

For personalised gift boxes, branded packaging or other custom products, the customer is responsible for checking and approving all names, logos, spelling, colours and artwork. Production begins after approval and, where applicable, receipt of payment.

Once artwork has been approved or production has begun, custom orders cannot normally be cancelled or changed. Small production-related differences in colour, positioning or finish are not defects where they are commercially reasonable. The customer confirms that they own or are authorised to use all logos, trademarks and other materials supplied to us and indemnifies us against third-party claims arising from unauthorised use.

11. Defects and warranty

Mandatory statutory warranty rights remain unaffected. In the event of a justified defect, we may, to the extent permitted by law, choose to replace the product, issue a refund or provide another appropriate remedy. Natural variations, minor packaging deviations, damage caused after delivery, incorrect storage or use contrary to instructions are not defects.

Claims should be submitted promptly with the order number, a description of the issue and supporting photographs. Customers must not dispose of allegedly defective goods until we have had a reasonable opportunity to review the claim.

12. Vouchers and promotional codes

Promotional codes and vouchers are subject to the conditions stated with the promotion. Unless stated otherwise, they may not be combined, exchanged for cash, applied retrospectively or used after expiry. We may cancel codes used fraudulently or contrary to their stated conditions.

13. Retention of title

To the extent permitted by law, goods remain our property until the purchase price has been paid in full.

14. Liability

The moment you, as the customer, place an order through our webshop, you agree to our Terms & Conditions stated here.

We are liable without limitation where liability cannot legally be excluded, including for intent, gross negligence and personal injury caused by us. To the extent permitted by law, liability for slight negligence, indirect loss, consequential loss, lost profit, loss of data and third-party acts is excluded.

Nothing in these Terms & Conditions excludes mandatory consumer rights or liability that cannot be excluded under applicable law.

15. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, epidemics, war, strikes, transport disruption, power or internet failure, government measures, customs delays, supplier failure or shortages. Performance may be suspended for the duration of the event.

16. Data protection

Personal data is processed in accordance with our Privacy Policy, available on www.drinkplash.com and https://plash-7477.myshopify.com. Payment and delivery providers may process data necessary to complete the order.

17. Electronic communication

Order confirmations, invoices, notices and other communications may be provided electronically to the email address supplied by the customer. The customer is responsible for keeping that address current and checking spam folders.

18. Governing law and jurisdiction

These Terms & Conditions are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods, to the extent legally permissible.

For business customers, the exclusive place of jurisdiction is the competent court at the registered place of business of PLASH Mocktails. For consumers, mandatory rules on jurisdiction remain reserved; in particular, consumers may retain the right to bring proceedings at their place of residence.

19. Severability and amendments

If any provision is invalid or unenforceable, the remaining provisions remain in effect. We may amend these Terms & Conditions prospectively. The version displayed at the time of the order applies to that order.
